The statement is more words than this site allows in the comments. Basically, the chocolate IS vegan but they process in equipment that also processes milk chocolate. They are aware that allergies are serious so, even though the equipment is thoroughly cleaned between products, they list milk since they can not guarantee there would not be any.
They state if better on their site in FAQ’s.
From the ingredient list provided, it seems they are vegan but I went to Divine's web site and found this info:

I am giving it 5 stars as not to give an unfair rating on something I haven't eaten but I wanted to let others know.
Delicious. I am impressed by the quality of these Chocolates.
These are simply delicious. We have bumped the Andes mints out of the rotation and these are the new holiday tradition. Friends like getting them as gifts as well !
